What the owner does with it. Almost any computer can be used for illegal purposes. For that matter, so can almost anything. As with a home PC, a person can receive illegal or pirated content, software, etc. If you are getting premium content for free, there is a good chance you are doing so illegally. Certainly this matters in some countries more than others. If you are in the US, I'd be careful.
In the interest of full disclosure, I am not a lawyer. Nor do I want to need one.
Use common since as your guide.
I guess a box could be considered illegal if it is loaded with software or plugins that allow for the receipt of pirated ccontent. Specially if it is sold programmed with the intent to receive pirated content.

Those sellers were setting the boxes up with software that would enable piracy out of the box. You can buy one from a reputable seller and it will be legal, but like above, it's what you do with it that makes it legal or illegal.

On a related note, kodi was removed from amazon because it could facilitate piracy. Somehow, internet browsers are still available.
