Ummm..... He says he uses Kisz kernel not 2dark4u. So I think you should double check facts first before going after lewy about using 2dark4u's kernel. Unless I am missing something.

Its his kernel and i cant do anything about that he dont want to relise the source.

And I'm not. Don't worry. I'm just giving a heads up to those that respect the GPL. Don't take what I said as a punitive attempt to insult you. Like I said, I'm just giving a heads up.

OK you should update your youtube video then. It says kizs kernel.

Lewy, if you dont want to get in trouble with this stuff, then make your ROM using a kernel that has sources. If people want to go and find 2dark's kernel and flash it, then that is up to them. But if you package his kernel in your ROM then you are distributing a kernel out of GPL licensing. So if you do not distribute it, then you cannot be blamed.

              Best I can tell you.

It is unfortunate because 2dark4u's kernel is good. The GPU tweaks he has added is astounding. His work and omega moon combined would provide for an epic kernel for the rock chip community.

Check out omegamoons kernel. It has over clocking up to 1.8ghz lol and he has fixed CPU scaling issues with the governor. I knew rock chip limited the CPU to 1.0 GHz intentionally ! :P just make sure folks with mk808 have heatsinks on theirs before attempting ANY sort of over clocking.

while this ROM is nice, there are a few issues with it:

                      1. The GPL non-compliance. Breaking the GPL is not nice. While I understand you are not responsible for the kernel and you do not have access to the sourcecode (i.e. it is "not your fault" it's not compliant) you are still distributing a kernel in violation of the GPL. Note that this *can* result in legal action against you and even Bob/Freaktab (This is not a "threat", it's just a heads up ). You should really provide the ROM with a GPL compliant Kernel and maybe mention the name of the current kernel in the readme.

                      2. The ROM comes with a few apps that are questionable and even shady. Foremost the app "Blackmat alpha". This app is used for piracy and offers access to cracked applications. Not only is this against copyright but in my oppinion this makes the app not trustworthy. This may be even malware. Another questionable app is "Advanced Task Killer". In the past, I found apps like these rather useless if not outright "invasive". Android - starting with ICS - got a really good internal task management system. Apps like this can break this system and cause instability and probaby data loss. I would not bundle it with the ROM, tbh.
Also, something I do not know, if you bundle ES File Explorer, can it still be updated via the play store? If yes, it's OK, if not I'd consider not bundling with the ROM seeing as it could potentially leave users with long outdated versions.

                      3. The ROM comes pre-installed with the developer setting "Force GPU Rendering". Now, I know from my old Galaxy Tab 10.1 that this can cause serious issues and performance problems with android, at lest it did on the Tegra 2. I am not sure if this is the case with the RK3066 as well, but it's something you should consider.

PS: please consider this constructive criticism

EDIT: The fact that the kernel is in violation of the GPL is really unfortunate. The GPU Performance is off the hook.

2dark4u overclocked the Malip-gpu to 433 or something I think from the initial 266mhz. But you're right, the legal complications is one of the reasons if I'm not mistaken as to why XDA doesn't allow non-GPL compliant developers to exist on the site.

Interesting. I assume the drawbacks of the GPU overclock is shortened lifetime of the Mali or why is no one else doing this?

Yes, XDA Developers is really strict about the GPL. And tbh, that is for a very good reason, if I were a site owner I would take this serious as well.

That's the thing though. For a device that's about $50, you should just use it and let it run to the ground. Lol. I believe that you would have replaced the MK808 before the MALI's shortened lifespan actually comes to fruition.

I could be completely wrong about the overclock though. I just deduced it based on 2dark4u's naming scheme of his files. He names them something along the lines of 720p 1416 CPU 433 GPU 1160 RAM, etc.

Lewy, will this work on Mk808B V1 clone(Mediatek MT5931 wifi chipset) or is there a clone V1 ROM in the offing? desperate to try this ROM for the XBMC h/w accelerated video.

I do not think my site here can be in trouble for Lewy's post. We are not hosting the download. Him posting here is just that a post to somewhere else. There are thousands of posts on XDA for ROMs with "questionable content" or GPL issue but XDA does not host them in any way, nor does it stay as an "attachement" which is also hosted by XDA. The kill the attachements.

As for APPs in ROMs. I am firmly against this UNLESS I get permission from the APP developer to add them to a ROM. We have a thread in our Dev forum where we post the "record" that the APP developer gave permission to distribute it in a ROM. Just because it is a free APP does not mean you have the right to distribute it! Permissions to do so is always required.
