i'm back with good news: i did not give up so i tried again and i solved the problem.
I just discovered (maybe everyone knew except me)in video settings that there is an option to set the refresh rate depending on the file properties.
i have a 5 years samsung tv and I just had Kodi forced to play all videos at 60mhz..... now that the refresh rate is "auto-adaptive", even the h265 are played wonderfully
